Consumer Protection Act 1987

The UK has consumer safety regulations which require that all food should be safe to eat and that it must comply with a wide range of written product and process specification standards. The Consumer Protection Act 1987 (CPA) ensures that all food products are subject to strict liability which enables any consumer who suffers injury or illness as a result of a defective product which causes food poisoning to obtain compensation from the product provider and it is not necessary for the consumer to have bought the product themselves. A product is defined as defective when “the safety of the product is not such as persons generally are entitled to expect” which has been left deliberately vague in order to catch a wide range of defects and leaves little in the way of potential defences to an accusation.

Food Safety Act 1990

In addition to the CPA consumers are further protected in regards to food-related illnesses and injuries by The Food Safety Act 1990 which includes the following offences :-

  • to make dangerous produce intended to be sold for human consumption
  • to supply produce for human consumption which is dangerous, contaminated, unfit for consumption or not of acceptable nature, substance or quality
  • to falsely describe, advertise or present food for sale

Bacterial And Viral Infections
