Negligence

It used to be the case that a solicitor would have to prove negligence on the part of the manufacturer to succeed in a medical defective product claim, however the law has changed and it is now only necessary to show that the injury occurred during ‘normal use’ of the medical product in question. Proving liability can still be complicated however and it is necessary to prove causation and show that there is a direct link between the medical product or medical device in question and the specific injury or injuries sustained.
