MEDICAL DEFECTIVE PRODUCT
CLAIMS ADVICE

The preparation of a medical defective product claim is typically complex. Highly qualified expert witnesses must be retained, often in conjunction with specialist forensic scientists who investigate the product in question for defects. These expert witness costs, coupled with a solicitors legal fees and court costs can be prohibitive to anyone thinking of taking legal action on a privately paid basis.

No Win No Fee

Our solicitors operate the no win no fee scheme whereby our clients never pay for any aspect of a medical defective product claim. Win or lose there is no charge. We cover court costs, legal expenses and all related fees incurred in a medical defective product claim. In this way we help you make a claim without any risk to your personal finances. A no win no fee arrangement is technically known as a ‘conditional fee agreement’ (CFA), introduced following the removal of Legal Aid funding for most personal injury compensation claims. Legal Aid is still available for clinical negligence compensation claims.

Negligence

It used to be the case that a solicitor would have to prove negligence on the part of the manufacturer to succeed in a medical defective product claim, however the law has changed and it is now only necessary to show that the injury occurred during ‘normal use’ of the medical product in question. Proving liability can still be complicated however and it is necessary to prove causation and show that there is a direct link between the medical product or medical device in question and the specific injury or injuries sustained.
