Damages

Damages awarded in a passenger accident compensation claim are for the sake of convenience, divided in to two categories – ‘general damages’ and ‘special damages’. One represents damages which are specific and easily quantifiable such as the loss of income or the cost of repairing or replacing personal property. The other represents less easily identifiable forms of loss such as physical suffering and mental anguish which cannot be calculated mathematically and must be assessed.

Time Limits

The Limitation Act 1980 applies to a passenger accident compensation claim and it determines the applicable time limits for making claims for personal injury which must be either settled or legal proceedings must have been issued within three years of the accident. There are exceptions to this general rule for those under the age of 18 years at the time of the accident, for those who are mentally disabled and in cases where the injury was not apparent immediately following the accident. Failure to abide by the time limits may mean that the potential passenger accident compensation claim becomes statute barred and the opportunity to make a claim may be lost forever.
