WHIPLASH COMPENSATION CLAIM
A whiplash compensation claim is by far the most common type of legal action associated with road traffic accidents. Compensation varies dependent on the extent of the injury and the length of the recovery period. There are occasions when full physical recovery is never attained particularly in vulnerable groups including those with a previous neck injury and the elderly. On occasions the injury can cause chronic long term pain especially if there has been damage to the bones or cartilage. In very serious cases surgical intervention may be necessary and rarely vertebrae in the neck are fused to alleviate pain. Awards of compensation for pain and suffering vary between £2,000 for a minor injury to over £250,000 for those in severe and chronic pain. In addition payments are made for loss of income and other reasonable expenses and losses both past and anticipated for the future.

Symptoms
Following an accident the onset of pain and discomfort can be immediate but is more often delayed by a day or so by which time the muscles of the neck may stiffen up causing pain on movement which may also be associated with discomfort in the shoulders, arms and upper back. There are numerous other minor symptoms that might be observed all tied into the swelling that causes pressure on the nerves resulting in discomfort. Other common symptoms include headaches as well as a tingling sensation in the arms and hands. If you believe you have suffered this injury in an accident that was not your fault, you may be able to make a whiplash compensation claim.

Negligence
In order to make a successful whiplash compensation claim it is first necessary to prove that the other driver has been negligent. This is not usually a problem as the injury most frequently occurs as a result of a rear impact. Immediately after the accident it is essential that the injured person does everything they can to preserve evidence. Full details should be recorded at the scene of the accident including a record of the time date and location with the names addresses and registration numbers of all parties involved together with full details of any witnesses. Photographs of the location, the damage to vehicles and the injury should be taken shortly after the accident and anyone injured should make an urgent visit to a general practitioner or to the accident and emergency department of a local hospital. This medical record will be of paramount importance at a later stage of the claim.
